Terms of Service

1. Acceptance of terms

By creating an account, downloading, accessing, or using Recallith, you agree to these Terms of Service. If you do not agree, do not use the service. You must be at least 16 years old to use Recallith.

2. Description of service

Recallith is a local-first AI memory application. Its capture, storage, indexing, and retrieval functions run entirely on your device. The Chrome extension can capture browser-tab activity and conversations from supported AI platforms. We provide account management, subscription billing, software distribution, and related account infrastructure. We may update, improve, replace, or discontinue software features from time to time.

3. Account registration

• Provide accurate and current account information.
• Keep your account credentials confidential.
• You are responsible for activity conducted through your account.
• Notify us immediately of unauthorized access at hello@recallith.com.
• Only one account is permitted per person.
• Accounts are personal and non-transferable.

4. Subscription plans

Free plan

• Browser and LLM-conversation capture.
• 30 days of history.
• 10 queries per day.
• Local Ollama integration.
• Up to 10,000 stored memories.

Pro plan — $9 per month or $72 per year

• Everything included in Free.
• Unlimited history and queries.
• Screen capture.
• Claude and OpenAI integration.
• JSON/CSV data export.
• Priority support.

Pricing may change with 30 days' notice to existing subscribers. A pricing change will not apply retroactively to an annual subscription before its renewal.

5. Payment and billing

Payment functionality is coming soon. Once paid subscriptions become available:

• Pro subscriptions will be billed monthly or annually through Stripe.
• All prices are in US dollars unless stated otherwise.
• Subscriptions will renew automatically unless cancelled before renewal.
• You may cancel at any time; access continues until the current paid period ends.
• No refund will be provided for a partial month, except where required by law.
• A failed payment may result in downgrade to the Free plan.
• Stripe will securely handle payment processing.

6. Acceptable use

You agree not to:

• Use Recallith for an illegal purpose.
• Capture data you are not authorized to capture, including another person's screen without consent.
• Reverse engineer, decompile, or attempt to extract the proprietary backend engine except where applicable law expressly permits it.
• Share account credentials with another person.
• Use automated tools to abuse the service or infrastructure.
• Circumvent Free-plan limits or access controls.
• Use Recallith to store or process classified information.
• Interfere with or disrupt service infrastructure.

7. Intellectual property

Recallith, its logo, and its branding are owned by Bartosz Bryg. Frontend and extension source code is available under the Business Source License 1.1. The backend retrieval engine is proprietary and closed source.

Your captured memories and other local data belong to you. We claim no ownership over your captured content.

8. Privacy

Your use of Recallith is governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

Recallith is provided “as is” and “as available,” without express or implied warranties to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free operation, that the software will meet your specific requirements, or that data can be recovered after device failure.

Because Recallith is local-first, we cannot recover your memories if your device fails. Backups are your responsibility, and deleting your account does not delete local data.

10. Limitation of liability

To the maximum extent permitted by applicable law, Bartosz Bryg and Recallith will not be liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability is limited to the amount you paid for Recallith in the 12 months preceding the claim. We are not liable for loss of local data caused by device failure, loss, corruption, or inadequate backups.

Some jurisdictions do not allow particular exclusions or limitations. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

11. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Bartosz Bryg from claims, damages, losses, and expenses arising from your use of Recallith, violation of these Terms, or capture of data you were not authorized to capture.

12. Termination

You may delete your account at any time through the account dashboard or by emailing hello@recallith.com. We may suspend or terminate an account that violates these Terms, engages in fraud, or remains inactive for more than 24 months.

After termination, Supabase account data will be deleted within 30 days, subject to legal and security retention requirements. Local data remains on your device. Pro access ends immediately when an account is terminated for cause.

13. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. For EU users, disputes are subject to Polish courts while mandatory EU and local consumer rights remain preserved.

For US users, disputes will be resolved through binding individual arbitration in New York, New York under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. To the extent legally permitted, you waive participation in class or representative actions relating to Recallith.

14. Changes to terms

We will notify registered users by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
